2022 MIPS Attestation is in full swing!

Performance Year (PY) 2022 has flown by and many deadlines have come and gone. One of those deadlines hasn’t yet, though: The 2022 attestation deadline is March 31, 2023. For now, let’s focus on 2022 MIPS attestation.

Attestation is the annual reporting of data performance for eligible providers to CMS (Center for Medicare and Medicaid Services) in four categories: Quality, Promoting Interoperability, Improvement Activities, and Cost categories. These combine to make up a Composite Performance Score (CPS) that equals up to 100. For this PY, a CPS of 75% or higher correlates a Positive Payment Adjustment. The earned Positive Payment Adjustment for PY 2022 is applied to all Medicare Part B reimbursements received in 2025.

For 2023, the category weights are as follows:

  • Quality-30%
  • Promoting Interoperbility-25%
  • Improvement Activity-15%
  • Cost-30%

Next, let’s address some frequently asked questions.

Question: Does everyone have to report on MIPS and, if reporting is required, can there be exemptions?

Answer: A MIPS-eligible clinician who bills $90,000 or more to Medicare part B AND provides care to 200 or more patients that use Medicare part B are required to report. Not reporting could result in a negative payment adjustment. A MIPS-eligible clinician who has not billed $90,000 or more in Medicare part B or provided care to less than 200 patients who use Medicare part B can be exempted from reporting.

Question: If a clinician or practice had uncontrollable circumstances that significantly impacted the ability to perform on any or all their categories, is there an Extreme and Uncontrollable Circumstances (EUC) that can be applied?

Answer: Yes, there is; however, there are only a few, very limited options available. These options will vary each year. For example, this year some of the options were for clinics affected by natural disasters (i.e., hurricanes, wildfires) and the COVID-19 pandemic.
